Proposed $50 LifeLabs data breach settlement dwindles to only a few bucks

CHILLIWACK — B.C. residents whose information was compromised in a criminal cyberattack that adversely impacted the LifeLabs database could have received a settlement disbursement of up to $50.

At least, that’s the way it was advertised.

But now that proposed disbursement of up to $50/person has dwindled to less than $8 a claim.

According to an email sent by KPMG on behalf of LifeLabs Tuesday morning (May 14), the proposed settlement is now $7.86 per claim due to a substantial number of people who submitted claims.

“Given the large number of valid claims received (i.e. 901,544), all class members who made valid claims will receive a payment of $7.86, which has been calculated in accordance with the Court-approved terms of distribution,” KPMG wrote in an email to settlement class members.

Eligible claimants will receive an e-transfer in the next five business days.

Back in December 2023, KPMG notified B.C. residents about a class action that began after unauthorized crooks compromised the LifeLabs database containing confidential customer personal health information, as announced by LifeLabs on December 17, 2019. LifeLabs defended the action and contested all allegations. LifeLabs says on its website that it is Canada’s largest community lab.

KPMG wrote in its December 2023 email that the Ontario court approved terms of a Canada-wide settlement agreement and distribution protocol for upwards of $9.8 million on October 25, 2023.

British Columbia residents were eligible to quality as a settlement class member if they were a LifeLabs customer on, or before, December 17, 2019.

Each settlement class member who completed a valid claim form before the deadline of April 6, 2024, would be eligible to receive an estimated compensation of $50, up to a max of $150, from which there would be court-approved deductions of legal fees, disbursements and taxes.

KPMG did advise claimants that the precise amount to be paid per person was contingent upon the total number of claims.
